A rock thrown from between a coal trucks tires hit and broke my windshield on the interstate.
Question Details: I got plate # and name on the door of the truck. I contacted the driver/owner he says it is a road hazard and not his fault and would do nothing. Does he have any liability
If the rock came directly off the truck itself, the owner would possibly be liable, but it is very difficult to prove that was the case. If it was a rock on the road that was kicked up by the truck or you cannot prove it came from the truck, then it is a road hazard and the trucking company is not responsible for the damage to your vehicle.
